  1. What is StudentDonate.com?

Studentdonate.com (the “Site”) allows private individuals to donate to current students to help them pay their college tuition and expenses. Students looking for donations post profiles of themselves on the site and donors can search the site for students to donate to. Donors can then make a donation quickly and easily to students they would like to support (the “Services”).

 

  • Terms Of Use.

By using the Site or Services you are agree to be bound by these Terms and Conditions of Use (the “Terms of Use”) and agree that you are responsible for compliance with all applicable laws and regulations and any applicable university guidelines. If you do not agree with any of the Terms of Use, you are prohibited from using or accessing this Site or using the Services.

 

  • Changes to the Terms of Use.

We may revise these Terms of Use at any time without notice. By using this Site or the Services you agree to be bound by the then current version of the Terms of Use. If you do not agree to the changes, you must stop using the Site and the Services.

 

  • Authors and Vistors.

When you use the Site to create or maintain (add, edit and delete content) a Studentdonate.com entry, you are an “Author.” The definition of an Author includes “Primary Authors” with the capability to create entries, deactivate their entry and add “Co-Authors.” Co-Authors assist the primary Author in maintaining their entry. All Authors of an entry are responsible to moderate the content on an entry, but the Primary Author is ultimately responsible.

When you use the Site to view general content or to visit another person‛s entry, you are a “Visitor.” We remind you that any other Visitor with permission to visit an entry can read your comments. Visitors do not have the ability to edit or erase their own comments. The term “User(s)” refers to an Author, a Visitor or both.

 

  • Eligibility To Use The Site.

You must be eighteen (18) years of age or older and a legal resident of the United States to use the Site and the Services. By using the Site or the Service you represent that you are at least 18 years old and a legal resident of the United States. In addition, if you register as a student, you guarantee that you are currently enrolled in the school you include in your entry.

 

  • Donations and Solitications Limited to Individuals.

Only individuals may donate or solicit donations on the site.

 

  • Limitations for Student Atheletes.

Student athletes and athletic programs are limited to using this site as Authors within the terms of the relevant NCAA guidelines, university guidelines and any college athletic boards guidelines limiting the solicitation and/or acceptance of donations from third parties.

 

  • Limitations on Submissions.

Text, photographs, images, illustrations, graphics, sound recordings, video and audio–video clips, links, and other materials that Users post on a Studentdonate.com entry are “Submission(s).”

 

You may not post any Submission on a Studentdonate.com entry that:

  1. violates any copyright, trademark rights, patent rights, rights in know-how, privacy or publicity rights, trade secret rights, confidentiality rights, contract rights, or other rights of any individual or legal entity
  2. is harmful; hateful; threatening; abusive; harassing; defamatory or libelous; sexually explicit, vulgar, lewd, obscene, or pornographic; racially, ethnically or otherwise objectionable or offensive; inappropriate; or inflammatory;
  3. you know (or reasonably should know) is false, deceptive or misleading;
  4. contains information that could be used for identity theft purposes, such social security numbers, credit card, bank account or other financial information, driver’s license numbers, security codes or passwords;
  5. contains “private” or “sensitive” information about any other individual, such as information about that person’s sex life, political opinions, criminal charges or convictions, religious or philosophical beliefs, physical or mental health conditions, or other sensitive matters, without first obtaining that person’s express permission;
  6. contains the image, name, or likeness of anyone other than yourself, unless that person is over 18 and you have first obtained that individual’s express permission;
  7. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  8. links to materials or other content, directly or indirectly, to which you do not have a right to link or that violates these restrictions;
  9. encourages others to violate these Terms of Use;
  10. violates any applicable local, state, national, or international law or university policy; or
  11. is inconsistent with the values or the spirit of the Studentdonate.com community.

  • We May Terminate or Limit Your Account.

We reserve the right to refuse or limit access to the Site or the Service to anyone for any reason at any time, including terminating your account, deleting any content you may have posted, or prohibiting you from using or accessing the Site or Service.

 

  • You Must Provide Accurate User Information.

You agree to provide accurate, current and complete information about you on the Site ("User Information") and to maintain the security of your username and password.

 

  • You Must Update Your User Information.

You agree to maintain and promptly update your User Information to keep it accurate, current and complete

 

  • Sharing Your Username and Password

YOU UNDERSTAND THAT ANY PERSON WITH YOUR USERNAME AND PASSWORD WILL BE ABLE TO ACCESS YOUR ACCOUNT (INCLUDING THE FINANCIAL AND PERSONAL INFORMATION). YOU ACCEPT ALL RISKS OF UNAUTHORIZED ACCESS TO YOUR ACCOUNT. You agree to promptly notify StudentDonate if you suspect any security breaches related to the Site.

 

  • No Solicitation of Users.

We expressly forbids the use of the Site for the solicitation of individuals or companies beyond the strict guidelines set forth in these Terms of Use. Any use of the Site for purposes other than spelled out in these Terms of Use will result in immediate revocation of all access and license to use this Site. Further, Studentdonate.com reserves the right to notify any relevant authority if the Site is used for any illicit or illegal purpose.

 

  • Not Responsible for Third-Party Actions.

You agree StudentDonate.com is merely providing a platform and that you will not hold us responsibile for the actions of the Users who use this Site.

 

  • Copyright and Limited License to use Materials.

All the materials on the Site, including our logo and all designs, text, graphics, pictures, information and other content (collectively, "Site Materials"), are the proprietary property of StudentDonate.com.

 

Permission is granted to temporarily download one copy of the Site Materials (information or software) for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

 

  1. modify or copy the Site Materials;
  2. use the Site Materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on the Site;
  4. remove any copyright or other proprietary notations from the Site Materials; or
  5. transfer the materials to another person or "mirror" the Site Materials on any other server.

 

This limited license shall automatically terminate if you violate any of these restrictions and may be terminated by Studentdonate.com at any time. Upon terminating your viewing of the Site Materials or upon the termination of this license, you must destroy any downloaded Site Materials in your possession whether in electronic or printed format.

StudentDonate, our logos and any other product or service name or slogan contained in the Site are trademarks of StudentDonate and may not be copied, imitated or used, in whole or in part, without the prior written consent of StudentDonate.

 

You may not use any metatags or any other "hidden text" using"StudentDonate" or any other name, trademark, product or service name of StudentDonate without our prior written consent.

 

In addition, the look and feel of the Site, including all page headers, graphics, button icons and scripts, is the service mark, trademark or trade dress of StudentNote and may not be copied, imitated or used, in whole or in part, without our prior written consent.

 

  • User Submissions.

You agree that any questions, comments, suggestions, feedback, ideas, plans, notes, postings, original or creative materials or other information, regarding the Site or the Service that are provided by you (“User Submissions”) are non-confidential and are the sole property of StudentDonate. You hereby assign all of your rights, title and interest in and to User Submissions to StudentDonate and StudentDonate is entitled to the unrestricted use and dissemination of your User Submissions for any purpose without acknowledgment or compensation to you.

 

  • References to Other Products.

Reference on the Site to other products, services, processes or other information does not constitute endorsement, sponsorship or recommendation by StudentDonate.

 

  • No Financial, Tax or Legal Advice.

StudentDonate does not provide financial, tax or legal advice. You agree to seek your own advisers regarding any financial, tax or legal implications from your use of the Site or our Services.

 

  • Materials Provided “As Is.”

The materials on this Site are provided "as is." We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this Site or otherwise relating to such materials or on any sites linked to this Site.

 

  • Site May Contain Errors and May Not Be Updated.

This Site may include technical, typographical, or photographic errors. We do not warrant that any of the materials on this Site are accurate, complete, or current. We may make changes to the materials contained on this Site at any time without notice. We do not, however, make any commitment to update the Site.

 

  • Site May Not Be Used For Spam.

You agree to not use this Site for spam, including using the Site as a destination linked from any unsolicited bulk messages or unsolicited commercial messages.

 

  • Fees.

We reserve the right to change the fees associated with our Services at any point in time without prior notice.

 

  • No Liability For Damages.

In no event shall Studentdonate.com or our suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on this Site, even if we have been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

  • Indemnification.

You agree to indemnify and hold harmless StudentDonate, our affiliates, independent contractors and service providers, and each of their directors, officers, employees and agents from and against any third party claim, suit, investigation, action, proceeding, arbitration or hearing ("Third Party Claim") and all costs, damages, losses, judgments, expenses (including reasonable attorney fees), obligations and liabilities of every kind and nature arising out of any actual or threatened Third Party Claim arising out of your use of, or inability to use, the Site or the Service.

 

  • Links.

We have not reviewed all of the sites linked to the Site and are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Studentdonate.com of the website. Use of any such linked website is at your own risk.

 

  • Privacy Policy.

Please refer to our Privacy Policy to learn how we collect, use and disclose personally identifiable information.

 

  • Disclosure to the Government.

You agree that we may be required to provide government authorities with access to your account information. As such, you authorize us to provide any of your information and access to your account (including any financial or other personal information stored in your account) to such governmental authorities as may order or demand the same, with or without notice to you.

 

  • Arbitration.

You and StudentDonate agree that the sole and exclusive forum and remedy for any disputes and claims arising out of these Terms of Use, the Site or the Services shall be final and binding arbitration.

 

Arbitration under this Agreement shall be conducted by the American Arbitration Association (the "AAA") under its Commercial Arbitration Rules and, in the case of consumer disputes, the AAA’s Supplementary Procedures for Consumer Related Disputes ( the "AAA Consumer Rules") (collectively the "AAA Rules").

The arbitration will be conducted before a mutually agreed single (1) neutral arbitrator. If the parties are unable to agree upon a mutually acceptable arbitrator, the arbitrator will be selected by the AAA.

 

Under no circumstances will the arbitration hearing extend for more than one (1) day. The location of the arbitration and the allocation of costs and fees for such arbitration shall be determined in accordance with such AAA Rules and shall be subject to the limitations provided for in the AAA Consumer Rules (for consumer disputes); provided, that either party may elect to have arbitration proceedings conducted by telephone.

 

The arbitrator may, in his or her discretion, award some or all attorney fees to the prevailing party. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

 

NO ARBITRATION OR CLAIM UNDER THESE TERMS OF USE SHALL BE JOINED TO ANY OTHER ARBITRATION OR CLAIM, INCLUDING ANY ARBITRATION OR CLAIM INVOLVING ANY OTHER CURRENT OR FORMER USER OF THE SERVICE, AND NO CLASS ARBITRATION PROCEEDINGS SHALL BE PERMITTED.

 

  • Limit on Time to Bring Claims.

In no event shall any claim, action or proceeding by you related in any way to these Terms of Use, the Site or the Service (including your visit to or use of the Site and/or the Service) be instituted more than three (3) years after the cause of action arose.

 

  • Severability.

In the event any provision of these Terms of Use shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.

 

  • Governing Law.

Any claim relating to this Site or our Services shall be governed by the laws of the State of California without regard to its conflict of law provisions.

 

  • Venue.

Wherever applicable and after exhaustion of administrative remedies specifically designated in this Agreement, judicial actions taken relative to this Agreement shall be brought in a court of competent jurisdiction, either state or federal, within the State of California.

 

  • Donations.

StudentDonate.com does not and is not responsible for monitoring, keeping records of, nor tracking the use of funds donated to member students using our platform.  We also do not  monitor or keep records of donations to students or the donated amount.  Students receiving the donated funds are soley responsible for appropriately using any received funds for college expenses, specific student projects, etc.

 

Individual donors determine what projects they consider charitable and are able to donate as they like.  StudentDonate.com does not determine the merits of any student project as charitable or any individual student as being worthy of receiving donations in any way.  It is fully each inidividual donor's responsibility to determine what projects and students are charitable and worthy of donation.  StudentDonate.com does not fund any student projects or make donations to students.  Individual donors use our platform to make donations for college and project expenses to students using a 3rd  party payment service, PayPal.  We do not at any time handle any of the funds or any part of the financial transaction nor are we liable or responsible in any way for the funds or the transaction.

 

StudentDonate.com does not in any way provide any sort of guarantee or assurance to donors as to the use of donated funds or monitoring the usage of the funds donated to students.  StudentDonate.com merely provides an online platform to connect students with donors and enable students to receive donations for their college expenses, and/or student projects using PayPal.  We provide no oversight as to the usage of the funds nor that the funds intended purpose is followed by the student.  We do not provide any guarantees, promises,  or assurances to donors  that their donations are used by the receiving student as they intended.

 

We do not determine or agree to determine if any funds are misused in any way.  It is the receiving student’s sole responsibility to appropriately use any funding.  We do not promise or provide any guarantee, assurance, or tracking to donors of the usage of donations received by students.  StudentDonate.com is in no way responsible or liable for the  usage or the misusage of donations received by students.  StudentDonate.com is in no way liable or responsible for monitoring the usage of any funds received by students.

 

StudentDonate.com does not and is not responsible for donating to students nor does it fund any of the student projects.  All donations are between individual donors using our site and subscribed students.  We do not disburse nor hold any of the donated funding.  All donations are direct transactions between the individual donor and subscribed student using a 3rd party payment service, PayPal.

 

By using our website platform, all donors and students agree to abide by the Rules for Donations in this section as well as the full terms of service described herein.
